Acceptance of Terms These Terms of Service govern your use of **GO AI Calorie** ("the App"), published by **GO AI Chat LLC** ("we", "us"). By downloading, installing, or using the App you agree to them. If you do not agree, do not use the App. These Terms apply to GO AI Calorie specifically and are separate from the GO AI Terms of Service (https://goaichat.app/terms) covering our other apps. ## 2. Who May Use the App You must be at least 13 years old to use the App. If you are under the age of majority where you live, you may use the App only with the involvement of a parent or guardian, and any purchase must be made by an adult who accepts these Terms. You must be able to form a binding contract. ## 3. What the App Does GO AI Calorie estimates the nutrition in a meal from a photo or a barcode, calculates daily calorie and macro targets from information you enter, tracks your intake, generates recipes, and — with your permission — shows Apple Health activity alongside your nutrition. Estimation and recipe generation run on third-party AI models (section 8) reached through our servers. Results are produced automatically; nobody reviews them before you receive them. ## 4. Not Medical or Nutritional Advice This section is important. Please read it. - **The App is not a medical device** and does not diagnose, treat, cure, or prevent any disease or condition. - **We are not your doctor or dietitian.** Calorie targets, macro targets, BMR and TDEE figures, Health Scores, trends, and insights are general information generated from formulas and from what you enter. They are not personalized medical, nutritional, or clinical advice. - **Consult a professional before acting.** Talk to a qualified healthcare provider before starting or changing a diet, a weight-loss plan, or an exercise routine — and especially if you are pregnant or breastfeeding, are under 18, have diabetes, kidney or liver disease, a heart condition, a history of disordered eating, or take medication affected by diet. - **Nutrition estimates are approximate.** Estimating a meal from a photo is inherently imprecise. Serving sizes, hidden ingredients, oils, sauces, and preparation methods are frequently misjudged, and barcode and recipe data may be incomplete or out of date. Do not rely on the App where nutritional precision matters medically — for example for insulin dosing, carbohydrate counting for diabetes management, allergen avoidance, or a medically prescribed diet. - **Allergies and intolerances.** The App cannot reliably detect allergens. Never rely on it to decide whether a food is safe for someone with an allergy or intolerance. Check the actual product label and ask the person who prepared the food. - **Recipes need your judgement.** AI-generated recipes, substitutions, and cooking times are suggestions. You are responsible for safe food handling, correct cooking temperatures, and checking every ingredient against your own dietary needs and restrictions. If you think you may have a medical emergency, contact your doctor or emergency services. Never disregard professional medical advice or delay seeking it because of something the App displayed. ## 5. Subscriptions and Payments - **Free download.** The App is free to download. Some features require an in-app subscription. - **Billing.** All purchases are processed by Apple and charged to your Apple Account. We never receive or store your payment card details. - **Auto-renewal.** Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours prior to the end of that period. - **Managing and cancelling.** Manage or cancel your subscription in iOS Settings → your name → Subscriptions. Deleting the App does not cancel a subscription. - **Trials.** Where a free trial is offered, any unused portion is forfeited if you purchase a subscription during the trial. - **Refunds.** Purchases are handled by Apple and are subject to Apple's refund policy. We cannot issue refunds for App Store purchases directly. - **Price changes.** We may change prices and what a subscription includes. Changes take effect at the start of a new billing period. ## 6. License and Restrictions We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for personal use, subject to these Terms. You may not reverse engineer, decompile, or modify the App; attempt unauthorized access to our servers or API; resell or redistribute access to the App; use automated means to submit images at scale or bypass rate limits; or use the App or its output to train a competing nutrition-estimation model or to build a competing dataset. ## 7. Your Content - **Your content stays yours.** You retain ownership of the meal photos, notes, recipes, and questions you provide ("User Content"). - **The license you give us.** You grant us a worldwide, royalty-free license to host, transmit, and process your User Content solely to operate the App and produce your result — including sending it to the AI providers in section 8. This license exists to run the service, and ends when the processing does. We do not use your photos or health information to advertise, and we do not sell them. - **You are responsible for what you submit.** You confirm you have the right to submit each photo and each recipe or video link, and that doing so does not infringe anyone's rights. - **Recipes from videos.** When you paste a cooking video URL, the App extracts ingredients, steps, and estimated nutrition for your personal use. Underlying videos remain the property of their creators; do not republish extracted content as your own or in breach of the source platform's terms. - **Results are not exclusive.** The same photo or prompt may produce the same result for other users, and results may change as models are updated. ## 8. Third-Party Services The App produces results using the following providers. Your use of the App and its output is also subject to their terms: - **OpenAI** — https://openai.com/policies/terms-of-use - **Google** (Gemini, including cooking-video understanding) — https://policies.google.com/terms - **xAI** (Grok) — https://x.ai/legal/terms-of-service - **DeepSeek** — https://www.deepseek.com/terms - **Apple** (distribution, payments, notifications, HealthKit) — https://www.apple.com/legal/internet-services/itunes/ We are not responsible for the acts or omissions of these providers, or for changes they make to their models or terms. Model availability may change. ## 9. Apple Health Where you grant access, the App reads Apple Health data to display activity alongside your nutrition. Health data read from the device is used only to provide features you can see in the App. It is not used for advertising or marketing, is not sold or shared with data brokers, and is not disclosed to third parties for their own purposes. You can revoke access at any time in the Health app. How this works technically is described in the Privacy Policy (https://goaichat.app/calorie/privacy). ## 10. Acceptable Use Do not use the App to: - Manage a medical condition in place of professional care, or to make clinical decisions such as insulin dosing (section 4). - Promote, encourage, or facilitate disordered eating, extreme restriction, or unsafe weight loss. - Submit photos that infringe copyright or privacy rights, or that contain other people without their consent. - Submit unlawful, harassing, hateful, or sexual content. - Probe or attack our infrastructure, bypass rate limits, or use the App in violation of applicable law or of Apple's App Store terms. ## 11. Our Intellectual Property All intellectual property in the App itself — its interface, code, artwork, name, and logo — belongs to **GO AI Chat LLC** or its licensors. Nothing in these Terms transfers those rights to you. "GO AI Calorie" and "GO AI" are our trademarks; do not use them without permission. ## 12. Availability and Changes We may add, change, or remove features and models, and we may limit or suspend the service for maintenance or for capacity reasons. We do not guarantee uninterrupted availability. Your log and cookbook are stored on your device and are unaffected by changes to the service. ## 13. Disclaimers THE APP AND ALL GENERATED CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY CALORIE COUNT, MACRO FIGURE, SERVING SIZE, TARGET, HEALTH SCORE, INSIGHT, OR RECIPE IS ACCURATE, COMPLETE, OR APPROPRIATE FOR YOU. You are solely responsible for decisions you make about your diet, health, and cooking. ## 14. Limitation of Liability WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR LOST DATA. OUR AGGREGATE LIABILITY IS LIMITED TO THE GREATER OF $100 OR THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow these limitations, in which case they apply to the fullest extent permitted. Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by our negligence. ## 15. Indemnification You agree to indemnify and hold harmless GO AI Chat LLC and its affiliates from claims, damages, and costs arising out of your User Content, your use of the App's output, your misuse of the App, or your violation of these Terms. ## 16. Termination You may stop using the App at any time by deleting it. We may suspend or terminate access for breach of these Terms. Sections that by their nature should survive termination — ownership, disclaimers, liability limits, and indemnification — will do so. ## 17. Changes to These Terms We may update these Terms. Material changes will be communicated in the App or on this page and the effective date above will be revised. Continued use after a change means you accept it. ## 18.
